THE PROCESS
Why get a pre or postnuptial agreement?
There are many reasons prenuptial and postnuptial agreements are gaining in popularity. Couples realize that should their marriage end, the outcome should be theirs to decide, not the states'. And if you have children and are thinking of getting married, an agreement is an important way to protect the ones who depend on you.
Nobody wants to think at the beginning of a marriage that it will ever end in divorce. However the statistics on divorce in the United States cannot be ignored:
- In 2005 2.2 millions couples married and 1.1 million couples divorced.
- The Bureau of the Census projected that 4 of 10 first marriages will end in divorce.
- People between the ages of 25 to 39 make up 60% of all divorces.
- Second marriages are at greater risk of ending in divorce than first marriages.
OUR SIMPLE 3-STEP PROCESS
|
Step 1: Schedule an Appointment Contact our office via phone, email, or Free Consultation request to schedule an appointment at a time that is convenient for you - day, evening, or weekend. Please make sure to contact us at least two weeks before your wedding (preferably six weeks) for a Prenuptial Agreement, or any other time for other services. A confidential questionnaire will be sent to you prior to the appointment in order to obtain initial information about you and your fiancee, your intentions, etc.
|
|
Step 2: Work with the Attorney Our California licensed attorney will review your completed questionnaire and discuss your options, make suggestions, and answer any questions you may have about the agreement or process. The attorney will then draft your agreement and email it to you within two days, along with next step instructions on how to validate the agreement. Your conversation with the attorney is private and that confidential. Your attorney is representing your interests and all documents are drafted by the attorney.
|
|
Step 3: Present the Agreement and Follow Up with the Attorney Present the agreement to your fiancee. Your fiancee may or may not hire a separate attorney to review the agreement with them. You may continue to work with your attorney through any changes or questions that come from a review of the agreement by your fiancee. All follow up work is included in the flat fee. Once your agreement is considered final by you and your fiancee, you may sign and notarize it together.
